A rape investigation leads police to a videotape that shows teenage boys having sex with an underage girl. Police say it happened on August 3rd, during a teenage alcohol party.
The 15-year old girl first told police she had been raped. A neighbor called police because the girl was throwing up in the driveway. Investigators now say the sex may not have been forced, but the teens involved could face other criminal charges.
Det. Sgt. Mike Elliott: "When they got there, they found a girl who was extremely intoxicated."
Police also found evidence of what happened inside a Roy home. It appeared a get together got out of hand.
Det. Sgt. Mike Elliott: "The videotape was recovered at the same time. It had been abandoned by the people involved."
All of them juveniles, police say the teens, who had been drinking, videotaped themselves having sex with a 15-year old girl.
Det. Sgt. Mike Elliott: "It doesn't look like it amounts to rape at this point, but I can't tell you whether it was entirely consensual until the investigation is complete. This videotape was made and everyone knew it was being made, but it was never distributed."
The investigation bears resemblance to a case involving six members of the Tooele High School baseball team. The team was at a tournament in St. George when members taped sex acts with an underage girl, and showed the tape. The teens pleaded guilty to various charges.
Det. Sgt. Mike Elliott: "Any time you have kids that age engaged in those types of acts, it's disturbing."
Roy police are still investigating. They say by law no one under the age of 16 can give consent, so the teen boys could be charged with unlawful sexual intercourse. The law says sexual exploitation of a minor and child pornography charges could also apply. It will be up to the county attorney to decide what charges, if any, will be filed.
